Smack! Injured kid sues school after dodgeball accident

Dodgeball: perhaps no grade school sport is infused with more cringing memories and dark humor.And the story of 12-year-old Shane Reese surely has both elements, along with a little "what were they thinking?" and could spell doom for the activity's future in New York schools.
The boy's been offered $20,000 by the Bronx school district thanks to an accidental ball in the teeth. A judge will decide if that's enough.
Let's take you back to Dec. 22, 2008, at Intermediate School 219 in the Bronx, N.Y. It was a rainy day and really close to Christmas -- the Bronx school district doesn't let out for winter break until Dec. 24 -- so many teachers had already taken off for the holiday. What to do with 100 students cooped up and buzzing over the upcoming holidays? A friendly game of dodgeball, of course!
Off to the school gym they went, where it was extremely crowded and none of the traditional soft rubber balls were to be found. No matter: plenty of soccer balls were rolling around the equipment room. Those will work, right? (Ouch.)
As for Shane Reese, he'd been in a car accident and had just had some teeth repaired. Teachers let him sit out of the wild game. As his lawyer, Mark Weinberger, told the New York Daily News, "Soccer balls were flying all over the place." Shane, on a bleacher bench, got one full in the face, damaging his new bridgework.
Yes, dodgeball is allowed in Bronx schools, but it's been considered an "inappropriate activity" since 2006, according to a department spokesperson: "there is no formal ban."
And the National Association for Sports and Physical Education issued a statement in 2006 discouraging dodgeball. While the school department didn't go so far as to say they were now considering a formal ban; likely officials are waiting until the judge rules on Reese's compensation offer; it is probably an inevitable result of this accident.
While the incident is highly regrettable and I feel for Shane, I can't help but wondering if Ben Stiller is kicking himself for not having been cast as this kid, whose injuries; coming as they did to a child who'd just been in a car accident; prove the axiom that truth is stranger than fiction.

It's time we protect our precious children from contact sports as we protect them from the rest of the world. Since by the time they grow up there will be no competion and Obama willing all jobs will pay minimum wage. Our great gov't WILL look out for us.

It looks by all of the posting that you have done is that all you ever do is sit back in front of a computer and talk down about liberals in every subject you run into. Mark, you are right on with your comment about this need to protect our children from everything. Who will protect them from the world when they grow up? The gov't will pass more nanny-laws to protect us from ourselves.
As for you Not Again, just what has Obama done right yet? World-wide apology tours, lots of time on TV, calling cops stupid. Just when does the blame game stop? He was elected a year ago and in January, when he's actually been in office a year, is that when he takes ownership of his presidency? Or will you continue to blame Bush for the next three years of Obama's mistakes?

i played dodgeball all the time in school. we even used basketballs.yeah we got hurt but we lived and grew up.
i never took my school to court because the gym teachers had to participate in a game of softball. teacher threw the ball trying to get me out and hit me in my ear, breaking my hearing aid. i went and got ice but i did not sue.
the parents should have only had the school pay the bill for new dental work and an ER visit not 20k
and just how close was he sitting to the gym floor? that should also be taken into account. if he was sitting close, school should not have to pay 20k. if on the very top bleacher, then it is up to the judge but not 20k. dental work redone and er visit would be enough.

As normal, on one hand they want kids to be up and active so they don't get fat. Then on the other hand, you can't do that because you might get a bruise or scratch.
I do agree the lad should be compensated as he wasn't playing, but they should pay to have the repairs done to his teeth. They shouldn't pay anymore.
Why don't the government just pay us all to stop at home so we don't get hurt????

I cant say that I played dodgeball in high school, but I can say that I endured dodgeball. The football coach was all the phys ed teacher and if he'd rather be doing something else, he had us "play" dodgeball. I didn't see anything fun about dodgeball. It was simply a way for the bigger and stronger guys to try to injure us weeklings.
When that coach died at an early age, I celebrated. Its been 40 years, and if I could find his grave today, I'd go dance on it.

Actually, depending on how much work was done, and then re-done, $20,000 is within reason. A dentist I worked for years ago charged $1500 for one post and core with a crown. That was approx 15 years ago.

This child endured much more than a "bruise and a scratch." He had his teeth knocked out. As a former teacher, I know that dodgeball is one of those activities that is used as a time-killer so that the teachers will not really have to teach a lesson. It was almost Christmas break, the real teachers were gone, and they were biding their time until the break. That is when kid got injured. The school district should pay because of its negligence. They were using the wrong equipment. There was no real learning happening in the classroom (which is the whole purpose of school). They were killing time.

Sometimes I find it amazing that I (along with my peers) made it to adulthood.
We played dodgeball, we sat on the bleachers watching others play, we didn't have seat belts or car seats, we didn't have cell phones, we ate foods that are now considered unhealthy, etc.
On the flip side, I had never heard of anyone suing anyone else. I distinctly remember my best friend having her two front teeth knocked out (accidentally) on the play ground. Her parents brought her to the dentist and had them taken care of. No suing...Just repairing.
Even if this child had brand new bridgework due to a car accident, how in the world is this accident worth $20,000?

I really have no problem with dodgeball, but using soccer balls was pretty stupid. I'm sure the school's insurance would cover the dental work, but 20,000???? And I have to wonder how much the family got for the car accident that messed up his teeth in the first place. I hope the 20k is denied.

The article didn't say how many teeth were "knocked out". But you can be sure it was painful. To the point however. Have you had a crown put in lately? Ask your dentist about the cost and multiple appointments to take care of more than one tooth. I think you will be surprised. It seems like $20,000.00 will cover it but we don't know how much damage was done. There might have been jaw or joint damage in addition to the lost teeth and pain. Since the teacher/s in charge assigned that period to dodgeball with improper equipment the amount could have been higher. The school is lucky it's only being asked for #20,000.00.

Having taught for over 30 years as an puiblic school elementary teacher, I can tell you that there are many very cool versions of dodgeball (including team versions)--many of which can be very nasty if a hard ball is used. But eliminating the game entirely is another way to over-protect the kids. Like anything else in life, you have to use some common sense.
