Wal-Mart's sick leave policy risks spreading swine flu

With swine flu in full swing, Wal-Mart's punitive sick leave policy is discouraging employees from calling in sick, lest they earn enough demerits to be fired, according to a report by the National Labor Committee.Wal-Mart employees who miss one or more days due to sickness or other reasons, including caring for a sick child, earn a demerit point and lose eight hours of wages. Employees with more than three absences in a six-month period will be disciplined, and four demerits in six months leads to warnings that can lead to dismissal.
A fifth absence, even if it's a sick day, will result in "active coaching" by management, according to the NLC report, and a sixth occurrence will activate a "Decision Day" when an associate can either be fired or put on a year-long trial period where they can be fired for any infraction and promotions are not allowed.
Wal-Mart employees who call in sick don't get a sick day on their first day off, although they can use a vacation or personal day, meaning they won't be paid for that first sick day, according to a New York Times story. The policy is meant to keep workers who aren't actually sick from taking a day off.
The policy is leading to Wal-Mart employees coming in to work sick all of the time, according to the NLC.
The irony there is thick because this summer Wal-Mart offered to help the U.S. Centers for Disease Control give H1N1 virus inoculations at its stores.
On its Web site's frequently asked questions about swine flu, Wal-Mart says to follow the CDC recommendations and stay home for at least 24 hours after your fever is gone except to get medical care or for other necessities.
"Stay away from others as much as possible to keep from making others sick," the Wal-Mart site recommends. "Staying at home means that you should not leave your home except to seek medical care. This means normal activities, including work, school, travel, shopping, social events and public gatherings."
You'll notice that staying away from work was included in that list.
Wal-Mart told the New York Times that it has policies to make it easy for its workers to stay home sick, and that it insists that workers with H1N1 stay home.
But with 39% of private sector workers not having paid sick leave, according to the Bureau of Labor Statistics, it's a reality that millions of Americans have to face any morning when they wake up sick: Stay home without pay and hopefully get better, or go to work, get paid and remain sick?
It's a tough call when you have bills to pay, but businesses that promote staying home if you're sick shouldn't hang the possibility of being fired over a worker's head for having to make that difficult decision.

Walmart...Wally World...needs to stop it! They are too greedy and seemingly un-concerned about their employee's, their families and the public to impose such a crap ass policy. How GREEDY must they be. If they are short of staff then bire more people, many people are in need of jobs right now, absolutely RIDICULOUS!!! Can you say "Class Action Law Suite"?

actually I work for a hospital and we have the same point system.. the only difference is that if we call in 1 day we can call off the second day but still only get 1 point. after 6 points there is a write up. 10 suspension and 14 fired. so I can relate to those walmart people..

CASINOS do the same thing. Demerits when you call out sick. At a CASINO you can also get fired for calling out sick. Of course, the customer does'nt care about getting sick. Wal Mart customers are probably do not care either.

Deb, I work at wal mart and we have the same thing, you don't get a point for each and every day you call out. Any days you call off in a row is just the one point.

I was at Wal-Mart yesterday and my cashier had very dirty, and obviously well worn rubber gloves on. I didn't want her to touch anything I wanted to buy. She never changed her gloves all shift long. Why is a cashier even wearing rubber gloves?? Let's keep on spreading the germs...

That's not totally accurate. If you call off sick for consecutive days for like the flu that still only counts a 1 absences. Other retailers like Macy's, Dillard's and.......... you have to be off sick for 3 or more consecutive days to get paid and a doctors slip is required to come back to works. They also have rules about absences like any other business. Businesses hire people to be there and work not to call off all of the time. That's why unions just help force businesses to keep deadwood employees that should have been jobless long ago!

Most companies that are unionized became that way because that was the only way employees could get fair wages and decent benefits. No union will stand up for a "deadwood" employee. They do however require that the employer have reasonable cause to fire an employee. Excessive absence is a reasonable cause. Wal-Mart is notorious for abusive and skirt the law employment practices. Like most big greedy corporations, they care only for the bottom line and consideration for the well being of their employees doesn't even enter the picture.

Okay, you apparently have never worked at walmart. A person that lives in my household works at one of the walmart stores and he can tell you that NO it does not count as just one sick day. Do us all a favor and get your facts straight before you start going off making allegations about things you clearly know nothing about.

have to agree,. seems better to have a job and pay check with a company with some funny policies than be laid off from a union shop with great benefits but who cant afford to keep employees.

have to agree with union problems also. worked 2 union jobs. both were the pits. last one a government job. union kept jobs for several dead wood who coworkers didnt even want around. had to do all their work and fill in everytime they stayed home. which was often. worked uaw for J>I>case corp. they were driven out of business by the union.

Dale, since you "seem to know" why these so called "policies" are put into place, then explain this one to me.....
Yrs ago, I worked for a company that made MEDICAL DEVICES. In fact, a few of our devices were used to save the life of our Ex Vice President of these United States!!!
During our 3 day orientation, we were told that if we were sick, we HAD to stay home. After all, we were making medical devices that were going INTO peoples bodies but then on our last day of orientation, we were told that if we called in sick more than 3 times in a yr, this would effect our yearly raises, stop us from moving up the ladder and most important of all.... we would LOSE our jobs!!! This made no sense and still doesn't!!!
They DIDN'T care if we went into work sick and because we knew what would happen if we didn't go in, our work place ran rampant with flus ALL YR LONG!!!
I'm a realist so I know that "some" people will actually abuse "calling in sick" but for those of us who DIDN'T/DON'T, it didn't matter. We were all punished the same!! And by the way. If we were out more than 3 days, we too had to come back with a Dr note but guess what??? That Dr's note DIDN'T stop them from writing us up. The ONLY time they worked was if you were sick with something that "could have" killed you!!!!
So get off that crap as to "why" companies have these rules/polices because until YOU try to work for a company like that, you have NO IDEA what it's like and how frustrating it can be!!! And YES, Walmart IS CONTRADICTING itself. *rolling eyes....... Peace

I gave my all to big blue Wal-mart for 8 years, the sick policy is bogus, and after Wal-Mart I never worked in a "Union Shop" the policies at my jobs since seem more in line of logic concerning sick days. if I'm sick I call in, I recieve 8 hours pay for each day i'm sick if I have sick time acrued,currently I have a mini vacation in sick time because I never know when it will be needed, I don't need to call in sick for a paid holiday because we have those and personal days ect. if I remember we had personal days at Wal-Mart too so there was no need to cheat to get off work. I'm sorry but Wal-marts sick pay 1 day no pay second day we will pay actually causes more cheating of the system why bother going back on day 2 or 3 even if I'm better? I'll actually get paid for being out. sorry no reason for Union bashing.

I actually work in a hospital in Dallas. We get verbal counselling if we call in sick or otherwise 3 times in 6 months. We do accumulate points and can be terminated with 12 points in 12 months. We cannot dip into our sick day bank until after 2 days of illness. So I don't think the Wal-Mart policy is any more stringent than other businesses.

Heres is the actual official Walmart attendance policy in regard to how absences are accumulated. If you are sick for up to three days consecutive or not for the same illnes it counts as one absence occurance. If you are out for more than 3 days for the same absence then you must have paperwork filled out by a doctor in order for the remaining absences to not count against you. Keep in mind these absences are in a rolling 6 month period. After 3 occurances in a rolling 6 month period then you are sat down and a verbal discussion is documented. You have to have 7 occurances in a rolling 6 month perios to be terminated from Walmart for attendance, unless of course FMLA paperwork has been filled out and chronic illnesses are documented. Those absences accompanied by a doctor visit do not count againnst you. Walmart also provides 2 days of personal time per year as well as vacation time to use for first day sick days, then you may use up to a weeks average hours worked as sick time which accumulates yearly if unused. We have a very liberal attendance policy and associates are given far more chances typically outside of the policy. I have been in management for Walmart in multiple states and now train for Walmart. So take these facts and consider them for what you wish. Just want to get the FACTS out there. Thanks

Well at our job and it is a hospital job we have to give our employers a 24 hour notice if we are going to be sick or it is considered an incident and held against us for our evaluations. If we are sick and sent home or they ask you to it still is brought up to them. Since we are not allowed to have over time if you works 7 days a week they make you leave early to make sure you do not have overtime but not any of the bosses are there over there time in fact they are late most of the time

The thing most people don't know is now we are also threatened with termination for calling in sick. Nothing is excused even with a doctors note!! We have all been waiting and hope some of the things they are doing now would be brought to light. Since they know how bad we need our jobs some stores are using threat tactics on a daily basis. We figured it would take someone accually dying at work before anything would be done.
