California accuses 22 Midas shops in 'massive' bait and switch scheme

California filed a $222 million lawsuit against the owner of 22 Midas Muffler shops after uncover agents discovered a "massive" scheme in which consumers were charged for unneeded repairs, California Attorney General Edmund G. Brown Jr. announced."These Midas shops were running a massive bait-and-switch scam, in which customers were lured in with the promise of cheap brake specials and then charged hundreds more for unnecessary repairs," Brown said in a statement. "This investigation revealed a shady and deceptive operation that violated the trust of its customers."
During the four-year investigation, agents found shops owned by Maurice Irving Glad regularly advertised sub-$100 brake specials to lure customers into paying for hundreds of dollars of work that was not needed or, sometimes, not even done.
The lawsuit, filed was filed by Brown along with Alameda County District Attorney Tom Orloff and Fresno County District Attorney Elizabeth A. Egan.
This isn't Glad's first brush with the law. He ran afoul of the state in the 1980s and was under a 1989 injunction prohibiting the practices being alleged.
Shops charged agents an average of almost $300 in unnecessary brake rotor resurfacings, brake drum repairs, brake adjustments, brake cleaning services and other services, the Attorney General's Office said.
UPDATE: Midas spokesman Bob Troyer said the company had no specific comment on the lawsuit.
However, he noted that Glad has been franchisee for 32 years and has been committed to training his workforce in technical and customer service areas. Since learning of the California investigation, the company has been working with those shops.
And, Troyer added, "We do not control the day-to-day in-shop operations of franchised shops."

It took 4 years as they had to prove a trend at each store then show they were all running a similar operation to tie it in as an organized scam by the owner. If they did a 6 month operation the numbers would have been skewed and not showed a definitive trend as to how they operated across the board....and side note how old is that midas sign with the crown thats an old one

Yes, this investigation took a long time, but in reading, this guy was in trouble before. Since he was still in business, it might be assumed the first case against him didn't bring a conviction. We're talking about a $222,000,000 lawsuit. It's better that prosecutors took their time and made sure all the "T" are crossed and "i" are dotted and bring this scumbag down.

They were investigating 22 stores. It takes time to get all the evidence needed to take this to court. You have to have as much proof as possible that the owner was aware of the practices and that it was not the work of the employees or one manager or just one facility.

Im think the midas in bridgeport ohio may be doing the same thing,, i took my car i many times and the LOOK for things that say needs fixed,,,ive heard them give the women some cock/ bull story about whats going bad on their car and says it should be fixed, even i was going to report them

They are all incompetent. I had a muffler put on by Midas. When I brought the car in I told them about a vibrating noise near the muffler. They inspected and told me it was loose heat shield on converter and they would take care of it. On my way home I heard a loud clang and a crunching noise. The shield came off and got wedged in the leaf spring of the car. I complained and they told me to bring the car in. I did. They told me they took the shield off and that the car really didn't need it. They told me they would give me a free oil change for my trouble. I call Corporate headquarters got a new converter with shield and the manager wasn't working for them anymore.

You didn't need the heat shield? They told you, you didn't need the heat shield? Do these mental midgets think that the automaker put them there for decoration? So they remove the thing and your vehicle catches fire because the heat coming off the converter causes the carpet in your vehicle to ignite. It may not ignite while driving because air flow under the vehicle will cool things, but when parked, the heat from the converter has no place to go but up and against the floorboard. And these "mechanics" are supposedly ASE certified??

Ken, I had a Buick dealer in Austin try that crap on me once. I locked my keys in my car when I was a kid. My dad convinced me that it was cheaper to keep a key in my wallet than have to pay for a locksmith. I have always kept a key in my wallet so when the thief at Covert Buick would not give me my car back after I got a ridculous estimate for some repairs I went into stealth mode. I walked the lot until I found my car, got in and drove off. This is no bull. I heard the guy whistle at me as I was driving away and I don't think I have ever gotten more pleasure from giving someone the middle finger salute.

They got my girlfriend in Hyannis, MA. They did unauthorized work and refused to get off the keys until they got paid. I told them on the phone that she only needed new brake pads, but they replaced every part they could think of. She got scared and paid them. I complained, but got no satisfaction. It wasn't my car and she wouldn't push the issue. $460 bucks in 1988 dollars. This has been going on a LONG time.
