CVS slammed again for selling expired products

CVS Pharmacy's propensity to sell expired products has led to a $975,000 settlement with California and an agreement to give $2 coupons to customers who find expired products on the shelves.California Attorney General Edmund G. Brown Jr. began investigating CVS last year and found the chain was routinely selling expired baby food, formula, dairy and over-the-counter medications.
Some examples provided by the Attorney General include: Gerber's Vanilla Custard, 11 months expired; Bright Beginnings Ultra Baby Formula, 3 months expired; and Gerber Baby Food Oatmeal with Applesauce and Bananas, 2 months expired.
This isn't the first time the national chain has been accused of selling expired products. Surveys in several other states, including New York, found widespread problems at CVS stores. New York Attorney General Andrew Cuomo said his office discovered that more than half of the stores visited were selling expired products, including baby products, eggs and dairy.
CVS spokesman Michael DeAngelis released a statement noting that the company "has denied all legal allegations made by the State of California and has agreed to settle the matter in order to avoid the time and expense of further investigation or legal proceedings."
And, he added, CVS has a policy in place to help clear items from the shelves before they expire.
"Any unintentional deviations from this policy that are brought to the company's attention are quickly rectified for customers," DeAngelis said. "The California agreement commits CVS to further strengthen its current product removal and monitoring practices with additional training for retail employees and managers, in-store notices reminding customers to check expiration dates and offering discount coupons to customers who notify store personnel if they discover certain expired products."
DeAngelis noted CVS is unaware of anyone falling ill due to the consumption of expired products sold in the stores.
Agreed to by California and CVS, CVS must do the following:
- Stop the sale of expired products in CVS Pharmacy and Longs Drug stores in California;
- Give consumers who find an expired item on store shelves a $2 coupon which can be used in any future purchase at a CVS Store in California for any product;
- Require employees to check at least twice a month that sell-by dates have not passed on infant formula, baby food, eggs, dairy products and over-the-counter medications;
- Establish a toll-free number to report expired products.

They've been nailed twice now. They don't care. My God people, they can't even vacuum or sweep the floors. Our CVS has the same messes in it that were there a couple of weeks ago. Some aisles look like nobody, employee or customer, has been there for weeks. Most stores watch the expiration dates and if something is close, they put it on sale and clear it out fast. Those are smart stores. That's where I shop.

Our Von's market here in Thousand Oaks, CA always has expired food. Every time we shop we find expired items. I'm forever telling them, but things don't change. I guess I need to shop elsewhere.

I used to work at the Quik Check in the Parlin section of Old Bridge I lived in Sayreville but moved to Fla over 10 years ago. They used to tell me to take the salads ( potato macaroni) and flip them so the top that was starting to look bad would be on the bottom. It is all over.

Agreed. My mother bought several jars of pickles from Tom Thumb, and when I ate from the "new" jar I realized something wasnt right. The expiration date read 2005. When she took out the others, they all had expired in 05. I know that she had in fact just bought them, because whenever she complains about lack of space, I go through her refrigerator and pantry and start throwing away anything thats expired, which I know I had already done twice this year.
Its possible that the store just bought the left over inventory from the Albertsons across the street (who were notorious for selling expired food) when it closed down. But when she visited again, she discovered cheese that, again, had expired in 2005, despite there being 2009 cheese next to it. I suppose 5 and 9 look similar when printed in the fashion they are, but thats sick.

OMG!.... At Our CVS.... my son is sick needed some Gatorade.. it was expired...told CVS employee, she started looking ... THE WHOLE SHELF WAS EXPIRED...I live in Florida.

the main reason expired product remains on shelves is the due to the lack of employees working in these stores. Companies like CVS cut back hours (not store hours, just staffing hours) and expect twice the amount of work.

I worked as Asst. Mgr. for Rite Aid for 6 months (2001) and this was "expected" to work (50) hrs. wk. and when they told everyone to "cut" payroll hours ... it was geared toward the hourly employees so our (50) hrs. were more like (60) hrs. so the $38,000 salary was averaging to $9./hr. Sick, isn't it?
There's just no respect in retail.....let them fall to their knees and if they want good people / employees to work for them....they'll have to RESPECT them and pay more than $10./hr.

I was a store manager for CVS for 4 years and I can tell you that this is true. They actually gave me an hours budget that was less than the number of hours my store was open and expected me to get everything done on my own in many cases. CVS obviously missed the memo about Lincoln freeing the slaves . . .

I work in the pharmacy and I can attest to the fact that they keep cutting the hours of the technicians but continue to expect that we will get glowing customer commendations. How can we adequately serve all of our customers when we do not have enough people? How do I take drop-off, do production and answer the phone? How does the pharmacist verify the correctness of the prescription, answer doctor calls, answer patient phone questions, answer patient in-store questions and help with production when I am stuck typing? How can I tell a patient that it will only be 15 minutes when there is a line of people behind said patient, 10 prescriptions (or more) ahead of them and the phone is ringing off the hook? I love my job and most people are very nice but I don't know how much longer I can take this. Oh yes, we are also supposed to be checking the shelves for expired drugs while this is all going on!!!

I worked in Eckard/Rite Aid also and what the others are saying is true, these stores all consistantly cut payroll so there's not enough people in the store to handle the registers and do all the floor work. There were many times where there was just one manager and one cashier for the whole store.
They want the store neat, help in the aisles for the customers, photo expertise and assistance, frequent cash pickups, aisles faced, truck unpacked quickly, floors swept, carpets vacuumed, throwbacks put back on the shelves, magazines changed out weekly, prices changed on the items and shelves daily, etc. but only have two or three people working in the store at any given time.

I work at a CVS and have been employed there for 5 years. The fact of the matter is, no matter what you do or how many times you check outdates, it still happens. We are REQUIRED to check outdates on certain products every month and once we check the outdates, we have to send the total number of outdates for each category online. There have been times we check a certain section of outdates, then we get more outdates on truck. People need to stop blaming the employees on the store level and think about the things that come in from the warehouse too.

I think they should also investigate the way they treat employees. They are scumbags. They will "find" or make up any excuse to "fire" managers with flimsy reasons. Managers get to a certain salary and then they fire them and replace them with lower salary people. Just disgusting. They work you long hours with no help....slave labor.
